Terms of Service

These Terms of Service ("Terms") govern your use of the website and charter services offered by AquaLuxe Miami LLC ("AquaLuxe Miami," "we," "us," or "our"). By booking a charter, paying a deposit, or otherwise using our services, you agree to these Terms.
1. Bookings & Deposits
A 25% non-refundable deposit of the package price is required to confirm your booking. The remaining balance is due in cash, card, or approved electronic payment on the day of the charter before departure. Bookings are not confirmed until the deposit has been successfully processed and you receive a confirmation email.
2. Pricing & Add-Ons
Package pricing covers the captain, fuel for a standard cruise within the published cruising area, USCG-required safety equipment, and complimentary bottled water. Add-ons (food platters, premium beverages, photography, water toys, etc.) are billed in addition to the package price. Prices are listed in U.S. dollars and may change without notice; the price confirmed at booking is the price you pay.
3. Cancellations & Rescheduling
- By you: Deposits are non-refundable. With at least 72 hours' notice, we will work with you to reschedule your charter to another available date within 12 months, subject to availability.
- By us: If we cancel due to unsafe weather, mechanical issues, or any other circumstance within our control, you may choose between a full refund of any amounts paid (including the deposit) or rescheduling at no additional cost.
- No-shows: Guests who fail to arrive within 30 minutes of the scheduled departure forfeit the deposit and the charter.
4. Weather & Captain's Discretion
The Captain has sole and final authority over all matters of safety and navigation, including departure, route, and early return. The Captain may modify, shorten, or cancel a charter at any time for safety reasons. If the Captain cancels before departure, Section 3 applies. If the charter is cut short after departure for weather or safety, refunds are issued at the Captain's reasonable discretion.
5. Conduct & Capacity
- Maximum capacity is 13 guests, including children. No exceptions.
- Illegal substances are strictly prohibited on board.
- Guests under 21 may not consume alcohol.
- The Captain may refuse boarding or end the charter without refund for intoxication, harassment, unsafe behavior, or refusal to follow safety instructions.
- You are responsible for any damage to the vessel or its equipment caused by you or your guests.
6. Liability Waiver
All guests must agree to our Liability Waiver & Assumption of Risk before boarding. Bookings cannot be honored without acknowledged waivers from all guests (parents/guardians sign for minors).
7. Photography & Media
Unless you opt out in writing before departure, you grant AquaLuxe Miami a non-exclusive, royalty-free license to use photos and video captured during your charter for marketing purposes (social media, website, advertising). Faces of minors will not be used without explicit parental consent.
8. Limitation of Liability
To the maximum extent permitted by law, AquaLuxe Miami's aggregate liability for any claim arising from or related to a charter is limited to the amounts you actually paid us for that charter. We are not liable for indirect, incidental, consequential, or punitive damages. Nothing in these Terms limits liability for gross negligence or willful misconduct where prohibited by law.
9. Governing Law
These Terms are governed by the laws of the State of Florida and applicable U.S. federal maritime law. Any dispute will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida.
10. Changes to These Terms
We may update these Terms from time to time. The version in effect on the date you book governs your charter. Material changes will be posted on this page with an updated "Last updated" date.
